Процесс развития современного семейного законодательства обусловил повышенный интерес к исследованию отдельных институтов, содержащихся в семейном законодательстве, а также к изучению в целом отраслевого семейного законодательства с учетом основных тенденций развития. Полагаем, что совершенствование правового регулирования семейных отношений должно строиться на основе научно обоснованной системы законодательства. В статье сформулированы отдельные предложения по изменению и дополнению действующего брачно-семейного законодательства. К сожалению, приходится констатировать, что многие семейно-правовые нормы не только не эффективны, но и противоречат концепции единства правового регулирования отношений, вытекающих из брака и принадлежности к семье.
The development of modern family legislation has led to an increased interest in the study of separate institutions within the framework of family law, as well as to the study of the family law legislation in general taking into account the main tendencies in its development. We believe that improving the legal regulation of family relations should be based on a scientifically sound system of legislation. The article formulates some proposals to amend and supplement the existing matrimonial legislation. Unfortunately, it must be noted that many family law rules are not only ineffective, but they also fall foul with the concept of uniformity of legal regulation of relations arising from marriage and family affiliation.
