Constitutional Basis of Right to Peace Regulation

Abstract

The paper presents a comparative study of the constitutional foundations of the regulation of the right to peace, which made it possible to identify the general and the particular in the constitutional regulation of the right to peace in the Russian Federation and foreign countries. It is shown that in the period of increasing globalization of modern society, conflicts are aggravating both within countries and between states, based on territorial, religious, inter-ethnic, socio-economic contradictions. The author justifies the position that the right to peace is the right of subjects, participants of legal relations to peace as the highest good. The provision of a globally coordinated response to threats to human rights that can be resolved only by joint actions at the national and international level is highlighted. Based on a comparative legal analysis of national constitutions, the author justifies the position about the need for constitutional enshrining in the Russian Federation the right to peace in the system of third generation subjective human rights, guaranteeing a state of protection from threats and challenges to life and health to everyone.
